In shortIf you run an Ember server, you're responsible for it and for your members' data. Follow the law and our
Terms of Service, publish your own privacy notice, and only use what Nookara sign-in gives you to run your server. We can remove any server from Nookara at any time.
1. Who these terms apply to
These Operator Terms apply on top of the Nookara Terms of Service if you are an "operator", meaning you:
- run your own self-hosted Ember server and connect it to Nookara (Nookara sign-in, identity tokens, the Ember directory, relays or any other Nookara service); or
- own a server hosted by Nookara (an address ending in .nookara.cc).
You accept these terms when you first set up a self-hosted server or create a hosted one. "We" and "Nookara" mean Ikelene (Natalie H.), who operates Nookara. If these terms and the Terms of Service disagree about running a server, these terms apply.
2. Your server, your responsibility
- Self-hosted servers: you control your server and everything stored on it, such as messages, files, voice and member lists, and you are responsible for it, not Nookara. Nookara can't access, export or delete data on your server; if your members ask us about it, we'll send them to you.
- You are responsible for your server's security, uptime, backups and moderation, and for everyone you let help run it.
- Hosted servers: Nookara stores the server's data on its infrastructure under the Nookara Privacy Policy, but you set the server's rules and moderate it. A free Starter server is limited to one per account. Plus is paid for in credits, in prepaid weeks, and doesn't renew by itself; a Plus server that isn't renewed becomes read-only after a short grace period and is archived after that.
- Answer your members' questions about your server in good time, and tell them how to reach you.
3. Follow the law and the Nookara rules
- Run your server in line with the laws that apply to you and to your members, including privacy and data-protection laws.
- Content on your server must follow the content rules in section 5 of the Terms of Service. Remove illegal content when you become aware of it. Child sexual abuse material must be removed and reported to the authorities.
- Respond to valid legal requests and to reasonable removal requests about your server, including requests from Nookara.
4. Have your own privacy notice
- Self-hosted servers must publish a privacy notice that members can easily find. It must say what you store, how long you keep it, who can see it, and how members can have their data deleted.
- Honour your members' requests to delete their data from your server.
- Hosted servers are covered by the Nookara Privacy Policy. If you collect extra data yourself (for example through your own bots or forms), you must tell members about it.
5. Use Nookara sign-in data properly
When someone joins, Nookara sends your server their user ID, username, profile picture, Pro status and the permissions they approved. You may use this only to run your server for that member. You must not:
- sell, rent or share it with anyone else;
- build profiles of people across servers, track them, or use your server to scrape Nookara;
- use identity tokens, signing keys or permissions for anything other than what the member approved;
- suggest that your server is run or endorsed by Nookara;
- try to get around Nookara's age checks, bans, blocks, feature restrictions or country and region restrictions.
6. Keep secrets secret
Keep your server's keys and any Nookara credentials safe. If they leak, or your server is compromised in a way that affects Nookara accounts, tell us at [email protected] as soon as you can.
7. Limits and fair use
Nookara services that your server uses, such as voice relays, storage and directory listings, have limits (for example monthly voice minutes or member caps). Don't try to get around them.
8. We can remove or ban servers
We can, at any time and without notice, limit, suspend, archive or permanently ban your server from Nookara sign-in, identity tokens, relays, hosting and the Ember directory, for example if:
- you or your server break these terms or the Terms of Service;
- your server is used to harm Nookara users;
- we need to for legal or safety reasons.
Banning a server doesn't stop its members' Nookara accounts from working elsewhere. We may also act against the Nookara accounts of the people running the server.
9. No warranty
Nookara sign-in, hosting and the Ember protocol are provided "as is" and may change; we'll try to give reasonable notice of changes that break servers. As far as the law allows, we're not liable for your server, its data, or losses caused by changes, outages, removals or bans, and section 12 of the Terms of Service applies. You agree to cover our reasonable losses from claims caused by your server or by you breaking these terms.
10. Changes and contact
We may update these terms. We'll tell operators about material changes, and continuing to run a connected or hosted server afterwards means you accept them. These terms are governed by the same law as the Terms of Service, including its protection of rights that can't be waived.
Questions: [email protected]. These terms are available in English, German and Portuguese. If a translation and the English version differ, the English version prevails.
